| The invention patent for "Mobile Power Charging Device and Mobile Power Sup |
Recently, in a case where Hangzhou Dian Electronic Technology Co., Ltd. (Xiaodian) requested invalidation of an invention patent owned by Shenzhen Jiedian Technology Co., Ltd. relating to Mobile Power Charging Device and Mobile Power Supply, the China National Intellectual Property Administration (CNIPA) issued a decision on request for invalidation, declaring the entire patent right of the patent in suit invalid. In this case, attorneys from Zhenghuan & Huanrun filed the request for invalidation after conducting thorough prior art searches and technical analysis. From the petitioner’s perspective, the attorneys made detailed comparisons between the patent in suit and the cited evidence in terms of technical field, technical solution and technical effect, and accurately identified the distinguishing technical features between the claims and the closest prior art, as well as the functions of such distinguishing technical features in the patent in suit. Meanwhile, regarding the differences between the technical means disclosed in another cited evidence for combination and the distinguishing technical features, detailed and sufficient arguments were presented from the perspectives of working principle, operation mode, function and effect. It was demonstrated that a person skilled in the art could make modifications based on common general knowledge when applying the technical means disclosed in the other evidence to the closest prior art. The attorneys fully explained to the Collegial Panel that such differences were obvious to a person skilled in the art without involving inventive effort, and successfully invalidated the patent in suit, thereby resolving the patent risks in the client’s business operations. Attorney Zheng Shufa has successively engaged in patent examination, patent drafting, patent invalidation and patent infringement litigation at the China National Intellectual Property Administration and well-known domestic law firms.
